These Terms & Conditions ("Terms") govern your use of the Try It On application ("App", "Service") as a Shopify merchant ("you", "Store Owner", "Merchant"). By installing or using the App, you agree to be bound by these Terms.

1. Service Description
Try It On provides an AI-powered virtual try-on feature that allows your store's customers ("End Users") to visualize how clothing items might look when worn. The service:
- Uses Google AI to generate try-on visualizations
- Processes End User photos and your product images to create composite results
- Operates as a visualization tool only – results are approximations, not guarantees
We are a technology provider. We provide the AI integration and infrastructure. You control how the feature is presented to your customers.
2. Merchant Responsibilities
As the Store Owner, you are responsible for:
Legal Compliance
- Ensuring your use of the App complies with all applicable laws in your jurisdiction
- Providing appropriate privacy disclosures to your customers
- Obtaining necessary consents from End Users before they use the feature
- Handling data subject requests from your customers
Content & Customization
- Ensuring your product images are appropriate for the virtual try-on feature
- Reviewing any customizations you make to translations, labels, or terms
- Not using the App to sell illegal, counterfeit, or prohibited products
Customization Disclaimer: If you modify the App's default translations, labels, privacy notices, or terms displayed to End Users, you assume full responsibility for the accuracy and legal compliance of those modifications. We are not liable for any claims arising from your customizations.
3. End User Terms
You are responsible for presenting appropriate terms to your End Users. The App includes default privacy and terms notices, but:
- You may customize these notices to fit your store's needs
- You must ensure customized notices remain accurate and legally compliant
- You indemnify us against claims arising from End User disputes related to your store
End Users must:
- Be at least 16 years of age
- Only upload images they have the right to use
- Not upload illegal, inappropriate, or harmful content
- Understand results are AI-generated visualizations, not guarantees
4. AI-Generated Content
Nature of Service
The virtual try-on results are generated by artificial intelligence (Google AI). You and your End Users acknowledge that:
- AI-generated images are approximations and may not accurately represent real-world appearance
- Results depend on input quality and may vary significantly
- The AI may occasionally produce unexpected, imperfect, or unsuitable results
- Generated images should not be the sole basis for purchasing decisions
Content Responsibility
Important: We act solely as a technology intermediary. We provide the AI integration with appropriate safety filters enabled, but we do not control the specific outputs generated by Google's AI. Neither we nor Google guarantee that all generated content will be suitable, accurate, or free from errors.
- End Users are responsible for the images they upload
- End Users are responsible for how they use generated results
- You are responsible for moderating how the feature is used on your store
- We are not liable for purchasing decisions made based on generated images
5. Acceptable Use
You agree NOT to use the App to:
- Generate illegal, defamatory, or harmful content
- Infringe on intellectual property rights
- Process images of minors under 16 without appropriate parental consent
- Attempt to bypass safety filters or content moderation
- Reverse-engineer, decompile, or extract the App's source code
- Resell or redistribute the service without authorization
- Use the service in a manner that violates Shopify's Terms of Service
6. Intellectual Property
- Your Content: You retain ownership of your product images and store content
- End User Content: End Users retain ownership of their uploaded photos
- Generated Images: Generated try-on images may be used by End Users for personal, non-commercial purposes
- Our Technology: We retain all rights to the App, its code, design, and underlying technology
- License Grant: You grant us a limited license to process your product images solely for providing the service
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The service will be uninterrupted, timely, secure, or error-free
- Generated images will be accurate, satisfactory, or suitable for any purpose
- The service will meet your specific requirements or expectations
- Any errors or defects will be corrected
- The AI will produce appropriate results in all circumstances
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of profits, revenue, data, or goodwill
- We shall not be liable for any damages arising from:
- End User claims or disputes
- Purchasing decisions based on generated images
- Inaccurate or unsuitable AI-generated content
- Your customizations to the App's default content
- Third-party claims related to your store
- Our total liability shall not exceed the amounts you paid for the service in the 12 months preceding the claim
9. Indemnification
You agree to indemnify, defend, and hold harmless Try It On, Wave Digital Studio, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your customizations to the App's content, translations, or terms
- Claims from your End Users related to the virtual try-on feature
- Infringement of any third-party rights through your use of the App
10. Service Availability & Changes
- We may modify, suspend, or discontinue the service at any time
- We may update these Terms with reasonable notice
- We may change pricing with 30 days notice
- Continued use after changes constitutes acceptance of modified terms
11. Termination
- You may uninstall the App at any time through Shopify
- We may terminate or suspend your access for violation of these Terms
- We may terminate accounts inactive for more than 12 months
- Upon termination, your right to use the service ceases immediately
- Sections on liability, indemnification, and governing law survive termination
12. Governing Law & Disputes
- These Terms are governed by the laws of Denmark, without regard to conflict of law principles
- Any disputes shall be resolved through binding arbitration in Copenhagen, Denmark
- You waive any right to participate in class actions against us
- For EU merchants, this does not affect your statutory consumer rights
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Shopify terms, constitute the entire agreement between you and Try It On regarding the use of the App.
